FRAUD
We have massive experience of defending clients accused of a vast range of fraud offences. From relatively straightforward offences involving a few documents to allegations of a higher complex and technical nature, involving in excess of ,100m. As members of the Legal Services Commission's Serious Fraud Panel we have specialist knowledge to assist us in the defence of all allegations of fraudulent trading or dealing.
VAT EVASION
The investigation and prosecution of VAT fraud lies in the hands of the Department of Revenue & Customs. Many clients find themselves called for interview by Revenue & Customs officers, but only a very few ever find themselves before the courts. This is perhaps the most common area in which it is possible to avoid clients ever facing prosecution. Where prosecutions do take place however they tend to be lengthy and involve the analysis of huge quantities of evidence presented in digital, electronic and documentary form. We have successfully defended a number of clients who have faced allegations of carousel and missing trader frauds.
DTI PROSECUTIONS
The Department of Trade and Industry still prosecute a vast number of offences. They are responsible for regulating the conduct of companies and company offices and look particularly at the way they deal with the practicalities of trading life on a day to day basis. We have a long history of defending companies, directors and other individuals who have faced DTI prosecutions. As a result of this we have come to have a good working knowledge of the business practices and techniques involved in industry, agriculture and the financial sector.
HEALTH & SAFETY
Health & Safety prosecutions have mushroomed in recent times. Clients accused of causing problems as a result of pollution, negligence, neglect, malpractice or shoddy workmanship can all find themselves under uncomfortably close scrutiny. Local Authority Health & Safety Departments are often willing to negotiate compromises in the hope of avoiding expensive and time consuming prosecutions. We have achieved success for many clients who have been prepared to enter into meaningful discussions with a view to changing or correcting their working practices. Equally, we have been successful in defeating prosecutions brought by unfair and unreasonable local government offices who have simply not been prepared to see sense.
PROCEEDS OF CRIME ACT
Since the enactment of the Proceeds of Crime Act legislation we have developed considerable expertise and gained a wide range of experience in defending clients and their assets against Proceeds of Crime prosecutions and confiscations. We are used to helping clients who face allegations of money laundering, on behalf of themselves or others, as well as those who are alleged to have taken land or goods that have been purchased wholly or in part with the proceeds of the criminal activities of themselves or others. By employing forensic accountants, obtaining witness statements and diligently delving into clients business and personal transactions, we have been able to challenge with success the assertion that property has been obtained by illegitimate means rather than as a result of inheritance, the receipt of legitimate gifts or hard work. |
