YOU KNOW YOU ARE GETTING OLDER…..

They used to say you know you’re getting older when the police officers look younger.  Then they used to say you know you’re getting older when the magistrates start looking younger.  For those of us practising in Nottingham it’s going to be a question of you know you’re getting older when the police stations start looking younger.

Back in 1995 a brand new £28m custody facility opened on the banks of the Trent Canal in Nottingham.  It was linked to the new, all-singing, all-dancing Magistrates’ Court.  The Magistrates’ Court itself was something of which the city was so proud they decided to licence its foyer for wedding ceremonies.  Concerts took place on the paved area outside the police station and it was deemed to be “the police station of the future”.

The custody sergeants were housed on a raised platform, which resembled nothing more than the deck of the Starship Enterprise.  There were more computers in the custody suite than there had been on Apollo 11 and the entire facility was watched over by a “new-fangled” CCTV system.

24 years on and it has all changed.  The talk is the closure and the building of a new “all-singing-all-dancing” not to mention “new-fangled” police station on a wasteland in a part of the city which has been calculated to be closest to most of the incidents to which officers are called.  The fact that the new police station will not link to any court buildings and will necessitate hundreds of thousands of pounds per year being spent on transporting prisoners, is a mere incidental.

For those of us who saw the police move from The Guildhall cells and the old Central Police Station to the brand new Bridewell, we can only reflect on the passing of time and the arrival of yet another generation of both police stations and criminal solicitors in Nottingham.

SUCKED OFF BY CPS

At a time when it is increasingly hard to persuade newly qualified solicitors to work in the criminal courts and offer their services as duty solicitors on a 24 hour rota basis.  At a time when experienced expert criminal solicitors are refusing to work on the 24 hour duty solicitor rota because they have done it for the last 15, 20, 25 or 30 years and cannot face it anymore. A new wound is opened up in the side of the Defence community.

Over the last three years there has been a steady flow of Defence solicitors to the Crown Prosecution Service.  The CPS offer a working life devoid of out of hours commitments.  There is no need to work in the decrepit and hostile environment of the police stations.  You will not meet with mentally unwell, drug addicted, or angry and antagonistic clients on a day to day basis.  Finally, you will benefit from all of the civil service benefits negotiated over a lengthy period of time by a skilled and experienced set of union negotiators.

21 years on from the last increase in legal aid rates, wages and conditions at the CPS seem increasingly attractive to the employees and Partners of criminal firms.

If Boris Johnson’s increase in policemen on the ground is to be accompanied by an increase in prosecutors to deal with the new prosecutions and arrests that must surely follow, we can expect more and more people to be sucked away from real or potential jobs within the Defence community.  Let’s face it, there are few enough people who want to work in crime overall.  If the Crown are to recruit more from this limited pool, the effect on Defence firms and duty solicitor rotas is likely to be catastrophic.

ADVERTISING PUFF!

The relaxation of restrictions on solicitors’ advertising has led to a world of change.  There will be those who regard it as unseemly and demeaning, to see solicitors claim to be “The best”, “The Cheapest”, “The Fastest”, etc., etc.

In recent times solicitors have claimed to be “The Most Caring”, “Friendly and Discreet” and, although you might think it would go without saying, “Professional”.

At The Johnson Partnership we have spent a lot of time wondering exactly what we ought to be claiming for ourselves.  Perhaps we should emphasise that we are “Any time, any place, anywhere”, like a good Martini.  Perhaps we should claim to “Put the freshness back” into law, although that might make us sound like a 1980’s Shake & Vac advert.  You could imagine there being a great deal of hilarity among the marketing partners.

On balance, and all things considered, what we reckon we would like to be as a firm of solicitors, is what British Airways used to claim they were as an airline which is of course “The World’s Favourite”.  When all is said and done, it is hard to disprove!

NOTHING MEEK ABOUT THE NEW FORCE IN CHESTERFIELD

On 15th January 2018, after almost ten years with the firm, Karl Meakin stepped out on his own account in the Magistrates’ Court.  An experienced prison lawyer, Karl is now strengthening the team of Chesterfield advocates comprised of Bob Sowter, Kirsty Sargent, and the inestimable John Wilford.

Karl will also be continuing to carrying on preparation and advocacy work for the Prison Law Team throughout the country.

The Chesterfield advocates are ably backed up by Richard Pell, Lucy Hooper, Yasmin James-Birch, and Lynda Gilbert.

With John’s added qualities as a regulatory specialist, the team has not only depth but considerable breadth.

Bob Sowter brings with him not only massive expertise in terms of adult and youth crime, but also a history of work carried out on behalf of the road haulage sector, which has ably equipped him to deal with a broader than average range of road traffic and vehicle related issues.

The remarkable Kirsty Sargent is the beating heart of the team, an excellent advocate and a superb organiser and administrator.

Karl could hardly be joining a finer group of lawyers who should ease him to greatness at an early stage.

THE GHOST TRAIN BECOMES THE LOVE TRAIN

As another date for submission of CDS12 form disappears over the horizon we are left reflecting on how different it is now to recruit new duty solicitors.  In short, all the criteria has changed.

Under the new 2017 Contract it is no longer sufficient to have somebody who will turn up to perform the obligatory amount of court and police station appearances while primarily working as freelance on their own account or even, who knows, as Tesco shelf stacker.

The new way is to bring somebody in for two or three days a week to ensure that they have their 14 hours carefully logged and stashed away for checking.

The October submission date saw us involve ourselves in lengthy interviews with a number of people, who we all hoped would be suitable recruits.

The new system brings with it closer scrutiny and a real consideration of the strengths and weaknesses of a duty solicitor candidate.  On this occasion it would be fair and honest to say that we had interviewed and made offers to three people who decided not to join us, but stay where they were.  Equally, we interviewed another three people at considerable length, to whom we decided not to make an offer.  The time invested in the recruitment process was quite significant particularly when this entails ticking fee-earning Partners away from their day to day labours.

We are delighted to say, however, that we have been successful in recruiting two wholly new duty solicitors as well as the lovely Helen Nicholson who will be returning to the fold.  All in all, the process has been an interesting and very enlightening one on a great many levels.

In recent times the LAA have visited both of our new offices. Back in May our new Lincoln premises at Unit 3, Waterside, Lincoln was visited by the LAA to confirm that the premises existed, to confirm that they were properly staffed, and to confirm that they met all of the requirements of the 2017 Contract.

 

Towards the end of June they had the pleasure of visiting at 4th Floor, 86 Victoria Street in Grimsby. We are happy to say that on this occasion the offices were found to be properly staffed, open for business, and with private interviewing facilities at the ready.

 

Inevitably, the new 2017 Crime Contracts have meant that a large number of new premises are being hired out as solicitors’ offices. We are delighted to see that the LAA are taking a proactive approach to confirming whether they are indeed compliant with the requirements of the new regime.

SUPER SARAH BREAKS ALL RECORDS!

On 3rd January 2017 Sarah Roberts qualified as a solicitor, after a number of years working in the firm’s Magistrates’ Court Department.

On 30th January 2017 she submitted her Duty Solicitor portfolio and completed the Interviewing and Advocacy Assessment.

By 20th February 2017 it was confirmed that she had been successful in passing both the portfolio and the oral examination. Sarah was a Duty Solicitor within 48 days of qualification.

In a firm that likes to pride ourselves on having staff move forward to realise their potential at the earliest opportunity, this really is some kind of a record.

Based in our Nottingham office Sarah is now engaged in all aspects of Magistrates’ Court and police station work and has already had three notable “Not Guilty’s”.

PASTURES NEW FOR PAM

We are sorry to announce the departure of Pam Coxon, a stalwart of The Johnson Partnership’s Doncaster office.

Since our arrival in Doncaster on 5th November 2013 one of the key members of our Doncaster team has been Pam Coxon. Pam previously worked as a member of the Youth Offending Team, as well as running her own business.

Over recent years, Pam has worked as an HCA, undertaking work in Crown Courts in Sheffield, Grimsby, York, Leeds, Nottingham, Derby and the like.

After nearly ten years with the firm Pam has decided it is time for a change, which will see her continuing to utilise her considerable skills in the Crown Court, whilst at the same time looking to develop a private client and probate practice.

We are grateful to Pam for all that she has done for us and we wish her all the very best for a happy and successful future.
